Section 01

The Contract

The contract is between you, the person making the booking on behalf of the group, the agent representing the group, and the Company, namely Bite Me Charter.

Section 02

Insurance

Personal travel insurance is not included in our tour or charter price. We strongly recommend that all guests carry valid and comprehensive insurance covering their entire trip.

Travel insurance

In the event that a trip is cancelled, rescheduled, delayed or modified due to weather conditions or any unforeseen circumstances, Bite Me Charter cannot accept responsibility for any loss of trip costs, airfares, lost holiday time, accommodation costs or any other financial consequence arising from such cancellation, rescheduling, delay or modification.

Guests are strongly advised to obtain travel insurance that specifically covers:

  • Trip cancellation and interruption
  • Weather-related cancellations or delays
  • Missed connections
  • Medical emergencies
  • Emergency evacuation
  • Personal belongings and equipment

Medical insurance

Please consult your doctor or GP well in advance of travelling to the Andaman Islands, particularly if you have any existing medical conditions. Seek professional medical advice regarding any recommended vaccinations, medications or other precautions required for travel to the tropics.

Our fishing operations may take place well offshore and in remote areas where access to medical facilities is limited. Fishing in tropical conditions involves exposure to heat, humidity, sun, wind and sea conditions. Guests are responsible for bringing all essential personal medication and taking appropriate precautions to maintain their health and safety throughout the trip.

Equipment insurance

Guests may obtain equipment insurance at their own discretion in their country of residence before commencing the trip. Bite Me Charter will not be responsible for loss of, or damage to, personal fishing equipment or other personal belongings except where required by applicable law.

Section 03

Health & Fitness Requirements

Guests must be in good health and reasonable physical condition to participate in our fishing and marine activities. It is essential that any relevant medical condition, physical limitation, allergy or other health concern is communicated to Bite Me Charter prior to arrival.

Guests suffering from severe muscular, chest, heart or bronchial disorders, severe asthma, uncontrolled high blood pressure, or other conditions that may be aggravated by offshore fishing or marine activities are strongly advised to seek medical advice before participating.

Remote operations

Our charters may operate in remote offshore areas where access to normal medical services, hospitals and emergency facilities is limited. Where necessary, medical evacuation may be prolonged, difficult and expensive. All medical, evacuation, repatriation and related expenses are the responsibility of the guest.

Bite Me Charter reserves the right to decline participation where, in our reasonable judgment, a guest's medical or physical condition may place themselves, the crew or other guests at risk.

No cash refunds will be made at the location.

Section 05

Weather Cancellations & Delays

The issue of daily sailing clearance is at the discretion of the relevant Port Management Authority and/or competent Government authorities, based on prevailing weather and sea conditions. The safety of our guests and crew is our highest priority.

If sailing or fishing operations are cancelled or restricted due to weather or sea conditions, Bite Me Charter will inform guests at the earliest practical opportunity. Guests are strongly advised to ensure that their travel insurance covers weather-related trip cancellation, interruption, delays and associated expenses. Bite Me Charter will not be responsible for losses arising from weather-related cancellation, delay, modification or interruption where such circumstances are beyond our reasonable control.

If our boat cannot operate

Where our boat is unable to operate during your booked trip due to mechanical failure, operational circumstances or other reasons within our control, Bite Me Charter will make reasonable efforts to arrange an alternative suitable boat or alternative fishing arrangement, subject to availability and safety conditions.

If we are unable to provide an alternative arrangement, Bite Me Charter may, at its discretion, provide a refund or credit relating to the affected fishing day(s), subject to the circumstances of the cancellation. Where applicable, refunds will be made to the original payment account. No cash refunds will be made in the Andaman Islands.

Rescheduling

Alternatively, where operationally possible, guests may be offered the option to reschedule the affected fishing trip for a future date, subject to availability. Any rescheduled trip will be subject to prevailing weather, boat availability, Government regulations, permits and applicable pricing.

Section 06

Change in Price

Bite Me Charter reserves the right to increase the price of a holiday, charter, expedition or package after booking if there is an increase in:

  • Government taxes
  • Duties
  • Permit fees
  • Port or harbour fees
  • Government charges
  • Regulatory fees
  • Other mandatory charges imposed by the Government of India, Andaman & Nicobar Administration, Department of Fisheries, Port Management Authority or other competent authorities

Any increase resulting from such changes will be communicated to the guest and, where applicable, must be paid prior to the departure date.

Section 07

Safety & Operational Discretion

Bite Me Charter reserves the right to modify, delay, shorten, reschedule or cancel a fishing trip or marine activity where necessary for the safety of guests, crew, vessel or equipment.

The final decision regarding sailing, fishing grounds, route, departure time and continuation of an offshore trip rests with the Captain/Skipper, taking into account weather, sea conditions, vessel condition, Government restrictions and overall safety. Guests agree to follow all reasonable safety instructions provided by the Captain and crew during the trip.

Acceptance

By making a booking with Bite Me Charter, the guest confirms that they have read, understood and accepted these Terms & Conditions.
